Lockheed Trademark License

Hi,

Was browsing the internet again. Found a link to the following Free Trademark license agreement from LMC (Lockheed Martin Corp.).

Very, very interesting for us designers.

Attached is a list of Trademarks.

Since paper models are copyrighted as 3d Paper Scupltures, designers are basically artists.

Trademarks need to be changed by 15% to be legal for use.

Notice that I have added blue to some that I'm most interested in.

Also notice that some are combined such as F22 Raptor, but SR71 and Blackbird are seperate.

They certainly have trademarked some very interesting names. Mother Nature might be peeved to find Blackbird as a trademark...

What are we supposed to call Blackbirds now?

Is a Redwinged Blackbird allowed because it is 15% different than Blackbird?

Since the world knows what a Blackbird is, do they loose the trademark becasue they have let unlicenesed use?

Or did they really design a Blackbird, giving it life and then telling mother nature it was ok to call the bird a Blackbird?

Or did they copy mother nature and violate her trademark?

I think that as long as it can be said that it was used for educational purposes, and that no direct profit is being reaped from the use, that the act of putting a Lockheed trademark on a model is Fair Use.

I would have to say that the model is more than 15% smaller than the original.

i don't know all about lawyer-jurist lingo but i read it as - "do what you want but make us look good and don't slander us or our products"
i e no harm in putting their logo on a model as long as it is not used to harm LMC's good name and reputation
am i right?

There is one thing that worries me...
"...Likewise, the free license does not apply to use of LMC’s trademarks for any form of merchandise such as toys, models, clothing, coffee cups, notebooks, electronic or video games, etc...."

I suspect that the particular verbiage means that you can't sell Lockheed's logo. This is lawyerspeak for we want to control everything, even though in practicality, we know we can't, but we're going to threaten everyone anyway.

I run a side business making patches and custom items like mugs, key chains, t-shirts, and other things, and I have some pretty strict rules for copyrights and trademarks. If there is so much as a question about it, I won't reproduce it.

Having said that, I honestly don't think that Lockheed-Martin would have a leg to stand on if someone built a model kit of an obsolete plane.

Then again, I am not a lawyer, and I don't play one on TV. So don't take what I say as Holy Writ.

Given that 90+% of the stuff mentioned in the pdf has been paid for by the taxpayers of various nations (ie. you and I), I'd say Lookenheed can bite me...

I totally agree. As a taxpayer if they're charging $12,000. to use the trademark to the model industry then I feel as a taxpayer that all of that money belongs to Uncle sam to lower my taxes.

Did you see where they tradmarked USA? Eagle?

As a US tax payer and citizen then, wouldn't you be entitled to a slice of the royalties from the rights to 'USA'?

My interpretation of the license agreement: an illustration falls under the free license agreement. Since all paper kits sold as an illustration, digital or printed, of a LMC trademarked plane...we are okay.

Purchasers just go an extra step of putting the puzzle of the illustration together...and OH!....it made a plane! Wow!
