so, their argument is "because we did such a good job when we ripped off Star Trek, we should be allowed to keep it"?
lol

In a Courtroom far far away...
"Gentlemen....you did such a superior job breaking into that bank Vault.
No criminal has ever done it so well.
Therefore, you can keep all the money you took!"

Ummm...as they are doing this for cost of materials and not going to make any money or show it in theaters, they won't be making any money...and BTW, Dave, they could come after you for your unlicensed for free movie related products if they win, citing that court ruling as a basis for it.

I signed with the comment "I'm signing because this is not about copyright - if it was, the studios would/should have taken this action when the crowd-funding campaign first began, not well after the successful (and free) release of the Prelude short. If the studios continue on this path, one expect that they will, in order to be morally consistent, go after every other item of fan fiction including every kid whoever pinned on pointy ears...."

Ummm?...are you singing? Is it the Star Trek theme?

Once again, "no profit" is not a pertinent factor or an excuse or justification.
People need to stop using it as a reason to steal stuff.

lol No need to threaten me about my Galileo model.
I'm well aware of what it is and what "unlicensed" means.
I never made any claims about my own work...not sure why you needed to include it in this discussion.
This case has no bearing on whether Paramount can or will ask me to stop sharing my Galileo model.
If they insisted I stop sharing the model, then I would. No argument.
In one day, one week, one year.

I made no comments about the cost or lack of profits from their work.
I commented on the argument of quality (of the work) as justification for doing something without permissions.
Their petition even includes a video meant to impress...to get your vote.
"Look how good this is...thats why we should be allowed to do it!"

Bottom line is if Paramount owns the stuff and doesn't want to share,
then "stop taking what isn't yours".

I believe Paramounts argument had to do with conflicting material in 2016 and 2017.
Since they are releasing a new movie and a TV show, they decided they don't want the competition or anything that would take away fan attention.
When this "fan" movie first hit the web, maybe it wasn't a concern to Paramount.
I personally think they have every right to want to control their own product no matter what.
And waiting one or two years is not an issue.

I see the problem being that Paramount has done nothing to stem the tide of fan films for the last 40 years. There even a Next Gen based fan series that has run (so far) 80 episodes and 5 feature length movies over the last 8 years (meaning they were in production and showing during the release of the last two Trek movies) and they have done nothing to them. So there's an inconsistency in their enforcement. Although they are underestimating the fanbase thinking that if there's another free movie about a different time in the history of the Federation, they won't want to see Beyond. I can pretty much guarantee I'm not going to watch the new series if i have to pony up $6 a month to watch it on line, so that's moot.

Every criminal trial results in a different sentencing.
Each case is judged individually.
Although precedent may be considered, each action/reaction/penalty is unique to the situation at hand.
(An odd analogy, but it gets my point across)

As Paramount has stated, with an upcoming new series and movie, and whatever else is in the works,
its their option to judge each "fan" production individually.
In this case, they are exercising their rights of ownership because they feel it might detract from their own productions.

Once again, just to clarify, thats not what I commented on.
I'm all for "fans" being able to show their love and admiration of a story, series and movie franchise.
I want to be able to design a Star Trek related paper model and share it with my friends for free.
But I still have no rights over Star Trek related concepts.
And regardless of how Paramount has dealt with model makers in the past, if they
decide today "no more paper models"...then I will have to respect and abide.

And I will not argue "but my model is so much better than anyone elses, thats why it deserves to stay available!"
And... I will not argue "but it was paid for by fans, and I am not selling it, or making any money from it"
because that has no significance when we talk about intellectual property.

In this case, I think its fair to be threatened by a "fan" production that rivals the Studio. And detracts from the studio efforts.
And that may be why so much has been tolerated to this point.
But once you start competing and stealing the limelight...you bite the hand that has fed you.

I say be thankful that Paramount and whomever else is involved in the "ownership" of Star Trek
have allowed what they have allowed so far.
Bottom line is they own their product.

I do appreciate that copyright owners do allow as much as they do, but Dave is correct in that Paramount should have rights to say 'yay' or 'nay' on this. I wish they would allow this to continue, but it is their right to say 'no'.

As unfortunate as that is
