New Pirate From Brazil

Looks like eBay has a new pirate from Brazil scanning everyones models and joining the Chinese already on eBay.

Wonder if this will ever stop. Is eBay that clueless that they keep condoning this habit?!?

It's not that ebay condones the habit....ebay cannot monitor the millions upon millions of listings put up on their various country specific websites. Reporting the listings is the only way to make them aware of the pirates. If you see a listing, report it. If you know the designer, contact the designer and have them report the listing.

I don't usually read these threads but I had few minutes....

I think the guy from Brazll must be a total knuckledragger - he has a 1/48 Lancaster on eBay with the following:

(1 48 Super Detail Version Avro Lancaster Paper Model PDF Format | eBay)

Attention eBay Staff:
I made this item myself and I own the license to sell this item on auction sites such as eBay.

This item does not infringe on any copyrights, trademarks, and/or intellectual property rights. If there are any questions regarding my eBay listings, please contact me for proof of license.

This aircraft paper model is an Avro Lancaster, a British four-engined Second World War heavy bomber designed and built by Avro for the Royal Air Force (RAF), the papercraft is created by Pilsworth, and the scale is in 1:48

I know that foreign languages can be problematic but not seeing the contradiction between "I made this item myself" and "created by Pilsworth"
suggests a general lack of intellectual capability.

I think Gary Pilsworth would have a good case to nail this clown on violation of creative commons restrictions.

I'd also like to see how he's going to distribute the files through the post - an envelope full of bytes?

Regards,

Charlie

The postage is free...he intends on contacting you after the sale ends
and arranging an e-transfer of some sort (email or download link).
This guy probably knows what he is doing to skirt ebay policies.
Thats why he includes the statement about the works being his.

...
I recently had a situation with eBay where I reported a listing, asking for its removal.
I submitted a request to the eBay Copyrights department
and I sent the same request to VERO.

I am now a registered member at VERO, which is apparently where you need to be.

Ebay...and VERO...eventually responded, telling me that they had considered my case
and ruled in my favour...and removed the offending listing.

Unfortunately this was more than 7 days after I had already got the seller to remove the listing himself!
LOL... ebay ...joke

Some sellers react very quickly to any sort of negative communication.
These are the honest sellers, who really don't understand what they are doing wrong.

Other sellers will laugh in your face, because they know exactly what they are doing
and they know they can get away with it.

If a designer wishes to protect his works from being sold illegally on evilbay,
first he must register with VERO.

...
We could take a shot here, on Gary Pilsworth behalf, and send the seller a message through the listing.
If we all say the same thing, he might get scared and pull the listing.
I would suggest, something like...
"You do not have permission to sell this model. This model was designed by my friend and fellow modeller Gary Pilsworth.
On his behalf I am ordering you to remove this listing and stop selling his works.
If the listing is not immediately removed I will report this listing to Ebay Copyright department and to VERO on grounds of intellectual property infringement."

In fact, I will go send this message right now. What the heck.

FWIW, I just sent this. Be interesting to see what the responses are...

Well, that was quick:

"Dear sgoti,

You're bothering me with these evasions charges, inform the ebay.

His response is:

"This is another model, an author friend of mine."

Which doesn't make any sense to me.
I am unsure what he is meaning by this.

I sent him a second message stating that his listing says the model is by Pilsworth.
I suggested I would report him to eBay.

He responded with:

"
Do what you think best, do not forget to give evidence because I have to present if asked."

I replied again (for the last time), asking about the model by Pilsworth statement.
And that I had already reported the listing (which I did, first).

His response: "Okay"

..
So, as you can see, he understands the game being played.
He doesn't care, because he knows it doesn't mean much.
Gary Pilsworth needs to report this himself...ask ebay to can this guy's listing.

I can't do much more.

...
UPDATE...he now sends me another message.
it says this:

"I am an honest seller and insist that you prove your charges. Where reporting what you are saying? You read my ad? Where to see it?"

And now, if you check his listing, the name Pilsworth has been removed.
LOL

Someone needs to buy his model and acquire the necessary proof to report it to ebay.
I can't because he knows who I am now.
You can also report the PDF file transfer.
Since ebay policy now states you can't sell email media.

I'll play. I just bought the item. When it is delivered, I will compare it against the Pisworth model.

Apparently he's postal-mailing something, since he knows email delivery is not allowed.
