Recolor permission from DAF trucks

After weeks of not hearing from designer G. Rutka, I thought I'd post this reply from DAF trucks:

Of course I emailed him my recolor of the Campbell DAF XF and I plan to do at least 1 more. My understanding is DAF doesn't just allow recolors, they encourage it, and only ask that we show what we've done. This permission is specifically for the paper models at this website:

I know at least 2 others do truck recolors, so this is good news. Send me a PM when you're ready to submit to DAF and I'll send you Mr. Kerstiens' email.

Clarify if I am missing information...


In this case DAF clearly does not claim rights to the Truck models they are distributing.
G Rutka does.
DAF claims no copyright or ownership, and it clearly states on the models they are a G Rutka design.
G Rutka obviously offered these models to DAF, for their use.

The contact (Kiersten) at DAF also does not understand paper modeling terminology.
To him, "recolour" might just mean "take out the crayons and recolour it!"

He loves the fact that you want a DAF truck model...and he loves that you want to "recolour" it.
Sure they "encourage" you to download and modify these models (for your own use).
But where has permission been given for wide spread redistribution?
I'm sure they wouldn't tolerate the use of DAF logos in any commercial way (free or not).

Of course you can graphically edit (recolour) any model you find on the web, without permission...
but that is still not permission to edit the model, replackage it, and reshare it (freely or otherwise).

In this case, permission is needed directly from G Rutka.
Saying "I tried to contact him, but he didn't answer" is not a valid argument, and not the same as "permission".
"waited weeks"...I don't care how long you've waited, you still need his direct permission.

From what I can see here, unless G Rutka says it is okay to repaint and reshare his designs, then its not.

Your position on copyright protection is abundantly clear from your postings.

Since you seem to care deeply about this issue but say that you don't know the full story, allow me to make a reasonable suggestion:
Email DAF, direct your query specifically to Mr. Kerstiens, lay out your argument exactly as you have here, then wait for his reply. You can do the same for Mr. Rutka.

For good measure, you can discuss with moderator RickStef why his instructions to me were inadequate. We communicated openly on the forum, not via PMs, so our discussions should be easy to find.

Hopefully this will improve guidelines about fair use for this forum.

For what it's worth, from the time I started looking it took over a week before I found an email address for Mr. Rutka that didn't bounce. And there is no guarantee that he would respond even if I joined FaceBook for that purpose. For the record I have never been a Dutch, or any other kind of, copyright lawyer and am choosing to keep my opinions private on that matter.

As I said, it appears based on what has been revealed, DAF is not who you should be asking for permission.
(I don't need to contact DAF, or anyone else...I'm not the one looking for any special privelages)

And again, just because G Rutka has not replied to your email, does not allow you to proceed without his consent.

I don't care about "Rickstef's inadequate instructions"...or whatever that means.

This has to do with taking a stand against those of you that think everything is fair game, if its in your own interest.

I will not apologize for taking a stand for those who can't, or those who won't recognize "fair use" .

What do I care about G Rutka and his models?
Why should I care about anyone's models (other than my own)?

...because thats what you want.
You want me to mind my own business and take care of only my own models.

Unfortunately...the paper modeling community (as a whole) is my business.
And what affects the fair and proper use of any artist's materials, affects me.

If G Rutka signs off on this, then I have no issues...but until he does...
Why are these models still available at this forum, if he hasn't?

I might not have been clear in my initial post here or used the right language, for that I apologize, but Dave is correct, you need to get permission from the primary author of the kit, if you can not, you can not share the file, no matter how much time passes, and as I have mentioned as well, if you can't get the permission, the only sharing you are allowed to do, is show the build of the repaint you have made.

I have placed the truck back into the moderation queue, and will sit there until you get permission from Gregor for us to host the file
